Lambeth licensing policy consultation

The licensed trade and the night time economy plays a large part in Lambeth in bringing jobs, economic growth and visitors to the borough. Lambeth has one of the highest numbers of licensed premises in the country.

However the sale of alcohol also has negative impacts and our levels of serious violence, noise, public nuisance and sexual assault are unacceptably high. The costs associated with some nighttime town centres fall on the taxpayer which cannot be right.

Lambeth new proposed policy attempts to rebalance the borough and moves us away from a permissive regime to one where a higher level of expectation is placed on businesses and those wishing to sell alcohol, as well as a more overt desire to shape our town centres and business districts.

Some of the key changes are as follows:

- the council and partners now have more powers to reject or review a licence application or existing licence. This will mean that the bits of the council who deal with noise, nuisance or criminality will find it easier to challenge poor practice.

- WHAT the licence is and HOW it operates needs to be clear
Previously a licence was a licence was a licence. Under this new policy Lambeth will ask applicants to be clear on what they wish to operate and stick to it - a night club causes different issues to a take away and therefore the rules and expectations need to reflect that.

- WHERE a licence operates makes a huge difference
In the new policy Lambeth has been more explicit about the opening hours and types of licence which can operate in town centres, shopping parades and residential streets. Some types of venue simply aren't suitable for some places and this guidance will help applicants and residents make a judgement about what is appropriate.

- WHO runs a licensed premises has a huge impact
A poorly run pub can cause more problems than a well run nightclub, and the new policy is very clear that responsible business is what we want in Lambeth. If there is a lack of confidence in someone's ability to understand the neighbourhood in which they wish to operate, or the rules of the game, then a tougher line will be taken when considering an application or a review.

- PEOPLE'S SAFETY and WELLBEING is of paramount concern to us
Alcohol enjoyed sensibly is something we welcome but it is a powerful drug which can put people at risk of harm or as a victim of crime. Lambeth will work with licence holders and individuals to ensure that we share responsibility to create a safe environment to have a drink.

- WOMEN'S SAFETY is a serious issue for Lambeth
We have one of the highest rates of sexual assault linked to the night time economy. Lambeth has adopted recommendations from the Every Woman Safe campaign which we will expect to be implemented, things such as having staff trained in dealing with sexual assault or harassment, the use of licensed mini cabs and a safe place for women to sober up before leaving a venue if they are incapable.

- The PROTECTION OF CHILDREN is a key licensing objective
If alcohol is sold to those underage Lambeth will now be operating a ONE STRIKE POLICY. If caught a licensee will be brought in to committee for a review of their licence which may be revoked. The licensee will need to satisfy councillors that they are operating safely and not putting children at risk if they are to keep their licence. Lambeth previously operated a three strike policy.

- THE POLLUTER MUST PAY for the effects of alcohol sales
It cannot be right that businesses who make healthy profits don't pick up the tab for costs that are incurred whether that be extra street cleaning, police or council enforcement presence or the operating of the regime itself. Where businesses get together to solve these problems we will bear the costs in mind but where people attempt only to make a quick buck they will be levied over a town centre or parade area.

Update from Duchy Arms licensing review

On 24 January the Licensing Committee heard an application for a review of the Duchy Arms' licence, after noise complaints. Their original licence allowed them to open till 2am. The Committee imposed amendments and conditions to the licence, which are detailed below. These bring opening hours into line with other pubs close to Kennington Cross, and impose conditions to reduce noise disturbance to local residents. Grounds for review:

At 1405 hours Monday 26th October 2009 Test Purchaser Bravo a boy aged 15 years entered Millennium Food and Wine 117 - 119 Kennington Road, London, SE11 6SF a grocery /off licence shop. He selected two 500ml cans of Stella Artois lager 5% alcohol by volume and approached the counter and was served by a man who later identified himself as X. He asked the test purchaser if he was 18 and he replied he was. He then asked him for ID, but was told he did not have any. Mr X told him to bring it next time.

The Test purchaser bought the lager and left the premises, outside he handed the alcohol to Trading Standards. Police and Trading Standards then entered the shop and challenged Mr X over the sale. The Test Purchase was pointed out, the offence of selling alcohol to a person under 18 was pointed out and Mr X was cautioned. He explained he had a lot of problems with anti social behaviour with youths in the shop and two week previously he had had his jaw broken when he challenged youth’s behaviour in the shop (not regarding an under age sale).

Mr X explained he was the Designated Premises Supervisor for the shop and is currently buying the shop from his Uncle. He said that he had worked previously in Enfield where the test purchasers’ have to tell their true age – (that is apparently how he spots under age test purchasers) and was puzzled when under age Lambeth test purchasers said they were 18. It was pointed out to him that if he has doubts about the age of a customer he must see valid ID proving that they are over 18 and that young people will say they are older in order to get alcohol. Mr X was issued with an £80 Fixed Penalty Notice by Police for selling alcohol to a person under 18 years old. He was told he could opt for a Court hearing if he wanted to.

On Wednesday 4th August 2010 an under age volunteer was sent into premises to test whether they would be sold alcohol. Sale refused.

On Saturday 4th August 2012 Trading Standards Officers visited Millennium Food and Wine 117 - 119 Kennington Road, London, SE11 6SF in regards to the Olympic extra cover duty, and spoke to the manager Mr Y The following problems were found;

• Pricing was missing on the confectionary.

• Out of date Nurofen for children were found displayed for sale

• Out of date Bonjela for children were found displayed for sale

The Manager Mr Y was warned that this was very serious and that they must be more careful. He was advised that they must check/rotate their medicines.

On Wednesday 29th August 2012 at 1205 hours, Test Purchaser Mike a boy aged 14 years old entered an off licence/convenience store called Millennium Food and Wine 119 Kennington Road, London SE11 6SF. He selected 4, 500ml cans of Fosters Lager 4% alcohol by volume. He approached the counter where he was served by a man who later identified himself as Mr Z.No questions were asked of the test purchaser who paid, was sold the alcohol, and then left the off licence.

Outside he handed the lager to a Trading Standards Officer, Council Officers then entered the shop, identified themselves and why we were there and challenged Mr Z over the sale. As he was working alone in the shop it was necessary to close the shop for a short while in order to deal with this matter in private and undisturbed by customers entering the shop and wanting service. The test purchase was pointed out; the lager sold to the 14 year old was shown. The offence of selling alcohol to a person under the age of 18 was pointed out and Mr Z was cautioned. He said he was tired (suggesting he was not concentrating) he was quiet and anxious for his boss to be informed, and said he was working at a restaurant nearby. He said the Designated Premises Supervisor responsible for the sale of alcohol was his boss Mr X who was called on the shop phone.

2 open packets of cigarettes were found behind the counter, Mr Z stated they were his and not for sale as single cigarettes. It is illegal to sell cigarettes singly. Pricing was also poor in the shop especially in respect of sweets. Uniform Police attended. Mr X, the DPS attended shortly after and I explained to him that an under age sale had taken place at his shop. He was apologetic.

An examination of the spirits on sale revealed seven 70cl bottles of High Commissioner Scotch whisky on display for sale were in fact duty diverted. This is where spirits made for export (and are duty free) are diverted before reaching the UK exit port. The rear duty free labels are removed and a false label with a fake HMRC duty stamp is then applied to the bottles. These genuine product bottles then appear made for the UK market and also appear duty paid. The bottles were seized, an examination of the store room revealed another 27 duty diverted bottles of High Commissioner Scotch whisky in the upstairs store room, these were also confiscated. Trading Standards Notice no 10052 was issued to Mr X who candidly stated that he had bought those bottles from a man who turned up in a van some time ago. He also said that he has problems with young black men in the area trying to obtain alcohol & cigarettes under age, and that he had suffered a broken jaw some time ago in an attack that followed refusing service. I told him that it was not easy running a shop in Lambeth; however he must not sell age restricted goods to those under age. (The test purchaser was mixed race)

There was no refusal register available, although not required by law is seen as good practise and to have a tangible record of refusing sales where no ID is produced by young looking customers. Mr Z produced a Bulgarian ID card as proof of ID. He was issued an £80 fixed penalty ticket for supplying alcohol to a person under 18. He was told he could opt for a Court hearing if he wanted to.

The Lambeth three strikes policy was explained to Mr X in that if there were three major concerns with an off licence; Lambeth Trading Standards would seriously consider reviewing the alcohol licence which may result in revocation. From memory there was an under age sale some time ago which I will not include (at that stage). However there is now an under age sale and duty diverted goods, so that is two concerns, one more and he will be appearing before the Lambeth Licensing Committee at Lambeth Town Hall. I also told him that a report will be forwarded to HM Revenue and Customs in respect of the duty diverted stock and they may take action against him.

She selected 1; 500ml can of Fosters Lager 4% alcohol by volume. She approached the counter where he was served by a man who later identified himself as Mr W. He asked the Test Purchaser for ID, she said she didn't have it with her, he then told her to 'bring it next time'. He then sold the alcohol, she left the off licence. Outside he handed the lager to a Trading Standards Officer, Council Officers then entered the shop, identified themselves and why we were there and challenged Mr W over the sale. He said the Test Purchaser looked 19 years old. Uniform Police attended

The test purchase was pointed out; the lager sold to the 16 year old was shown. The offence of selling alcohol to a person under the age of 18 was pointed out and Mr W was cautioned. He said that he didn't actually work at the shop and was only looking after the premises for his friend. He said that he had received no training for selling alcohol. It was put to him that as he asked the Test Purchaser for ID, he must have thought that she was or may have been under 18, and having asked for ID and not been shown ID (18+) he should not have sold alcohol. He accepted this.

The Designated Premises Supervisor responsible for the sale of alcohol is Mr X who was working in a restaurant nearby was called and attended shortly after. He was informed of the under age sale. He said that Mr W was his cousin he had asked to look after the shop as his usual worker was not available.

There was no refusal register available, although not required by law is seen as good practise and to have a tangible record of refusing sales where no ID is produced by young looking customers. Mr W produced a DVLA driving licence as proof of ID. He was issued with an £80 fixed penalty ticket for supplying alcohol to a person under 18. He was told he could opt for a Court hearing if he wanted to.

The Lambeth three strikes policy was explained to Mr X in that if there were three major concerns with an off licence; Lambeth Trading Standards would seriously consider reviewing the alcohol licence which may result in revocation. From memory there was a previous under age sale as well as a large seizure of duty diverted alcohol, therefore this was the shops' third strike and he should expect to be reviewed.

Duchy Arms and Area licensing reviews because of noise disruption

 The Council's Noise Service has applied for reviews of the licence for two separate premises in our area because of disruption to residents caused by noise.

Grounds for review:

Lambeth Noise Service is making this REVIEW as a result of noise complaints received from residents and following an inspection of the premises.

Complaint History

A total of five complaints have been received this year from four different complainants:

22.1.12 at 00:42 hours - loud amplified music & bass - complainant lives in Newquay House, Sancroft Street SE11 5UN. Officers called back but received no reply.

6.5.12 at 00:46 hours - loud music and shouting - complainant lives in Courtenay Street SE11 5PH. Call cancelled by complainant before officers arrived.

26.5.12 at 01:43 hours - loud music from a non-amplified musical instrument - complainant lives in Newquay House, Sancroft Street SE11 5UN.

14.7.12 at 02:27 hours - loud shouting outside pub, 6-12 people drunk since 23:30hours.
Complainant lives in Newquay House, Sancroft Street SE11 5UN.

21.7.12 at 12:32 hours (Email to Cllr S Morgan) - loud amplified music, over 40 people drinking in the street, singing, shouting, smoking, arguing, swearing. Police attended having been called by another neighbour.
No statutory nuisance has been substantiated by noise officers due to the noise being lowered, stopped, or no visit being made.

Noise Officers visited the premise on 31.7.2012 at 17:25 hours and spoke to the Designated Premises Supervisor. Officers were advised that there is no automatic noise control device installed at the premises to control amplified music. There is a juke box connected to five loudspeakers and DJ's bring in there own sound equipment. There is a small wall-mounted volume control device which is manually operated and can be easily tampered with by staff. Officers do not consider that the wall mounted device is an appropriate means of controlling amplified music noise on the premises.
There is only one A4 sized public notice displayed on the rear exit door to the car park asking customers to leave quietly. Officers recommended that further signs should be placed on each of the other two exit doors.

Officers are of the opinion that the failure to install a sound-limiting device which is set to officers' satisfaction is a breach of the licence condition under Annex-2, No.2 the prevention of public nuisance. .

Furthermore, the failure to display 'quiet' signs on all the exit doors is also considered to be in contravention of Annex-2 condition (No.2) the prevention of public nuisance.

To prevent public nuisance, officers recommend the following:

1. The terminal hour be reduced to 23:00 hours.

2. A suitable automated sound limiting device be installed at the premises to control all amplified music and/or speech. The device shall be set at a level determined and approved by the Licensing Authority (Noise Officers) and thereafter maintained at the approved level for the duration of use.

Area - 67-68 Albert Embankment, SE1 7TP  

Grounds for review:

This Review is being made on the grounds that the premises generate noise complaints from local residents. Officers believe the activities at these premises engaged the public nuisance element of the licensing objectives.

Noise officers visited Albert Embankment on 26.8.12 at 08:00 hours and observed loud amplified bass music emanating from the premises known as Area. Officers visited a complainant living in St Georges Wharf and clearly heard loud bass music while standing in the complainants bedroom. The officers reported that although the bass was clearly audible it did not amount to a statutory nuisance under the Environmental Protection Act.1990. However, the officers believe that the degree of interference and annoyance caused by the bass music noise did engage the public nuisance element of the licensing objectives under the Licensing Act 2003.

At 08:33 the officers revisited Albert Embankment and confirmed the source of the noise as being Area night club. Officers observed that the main entrance door was kept wide open white the inner lobby door was closed. Officers met Mr Ryan Elder, the Licensee and together they inspected the music sound system & DJ console. Officers believe that there is no automatic sound limiter in place to satisfactorily regulate and control the volume of the music. Officers believe that a compressor unit is connected to the sound system but they are not satisfied with the settings as bass noise continues to emanate from the premises into the surrounding area and remains audible in residential premises.

Officers consider the following conditions should be applied to the premises licence.

1. A suitable automatic sound limiting device shall be installed at the premises to control all amplified music and/or speech. The device shall be pre-approved by noise officers and the acceptable level of noise shall be determined and set to officers' satisfaction and thereafter maintained at the approved level for the duration of use.

2. Both lobby entrance doors should remain closed while regulated entertainment takes place and that the doors should be operated one at a time to allow patrons to enter and leave the premises with minimal noise escape.

Officers additional concerns or comments:

Noise officers are concerned about the opening hours of the venue and would prefer to see terminal hours brought back to a more reasonable time, for example 03:00 hours.

Mansion House pub tries to push back opening hours just weeks after licence compromise

Most residents were pleased to hear that the Mansion House pub is being brought back into use, but were unimpressed by the owners' attempt to sneak through a licence allowing them to open till 4am every morning.

After many residents objected, at a Licensing meeting on 17 July the Committee agreed a sensible compromise, allowing the pub to be open till 12:30am every day, and 1:30am on Thursday, Friday and Saturday.

Now the owners have returned to the Licensing Committee with a new application attempting to push back the opening time by another half hour every morning.

The full application for a variation is as follows:


To remove the condition imposed by the licensing sub committee restricting use of the outside frontage to a terminal hour of 22:00.

Sex Establishment Licences in Vauxhall
The Government changed the law two years ago to create a new sexual entertainment licence, that was separate from the previous licence regime. Lambeth did a consultation on the matter and has since adopted these rules. As a result any venue offering such entertainment needs to apply for a new licence.

Most of the press on this subject relates to men paying women to strip, but this is not what is going to happen in Vauxhall. In fact, the position will be that the activities in the clubs will continue as they always have done. They do not intend pay people to strip. We have included some explanations from the clubs concerned.

HRH Clubs Limited, the owners and operators of Fire Nightclub, Area Nightclub and Covert Nightclub, pride themselves on offering their customers an enjoyable, safe and well managed entertainment service. We value our customer input and also value the views of the local community. For this reason we wish to clarify the reasons that we have applied for the Sexual Establishment Licences.

New legislation was passed by Parliament meaning that any venue that wished to provide nude or striptease entertainment require a Sex Establishment Licence. Premises also showing adult R18 films also require a Licence. The regime provides numerous safeguards to ensure this type of entertainment is provided in a safe, proper, legitimate and controlled manner. We have historically provided ancillary entertainment at our venues that falls into these categories and have done so without complaint.

As a result of the new legislation, we are required to apply for the licences in order to continue to provide the entertainment that we offer at some of our events. The type of relevant entertainment we provide includes GoGo dancers, R18 or special shows. All this type of entertainment is ancillary to the primary nightclub use. There will be no change whatsoever to our current operation, we will not be opening a lap dancing club or similar, we simply wish to maintain the status quo and legitimately continue the ancillary entertainment we have previously provided for many years.



In Oval Ward Fire and the Eagle have also applied for Sex Establishment Licences.

Police call for review of licence for Area and Fire

The Police have called for a review of the licences for two of Vauxhall's biggest and most popular LGBT clubs.

In the case of Area (67-68 Albert Embankment) the 'Police have expressed concerns for the safety of persons attending this venue, following a number of covert operations during which officers observed the supply and usage of illegal drugs, and incidents of drink spiking within the venue. Police have stated that they believe the premises’ management to be 'either unwilling or unable to tackle the drugs problems which are endemic to this venue''.

In the case of Fire (39-44 Parry Street) the 'Police have expressed serious concerns for the safety of persons attending this venue, following a number of covert operations during which officers observed the supply and usage of illegal drugs, and test purchasing officers were supplied with illegal substances themselves. Police have stated that they believe the premises’ management to be 'either unwilling or unable to tackle the drugs problems which are endemic to this venue''.
